RE:

Request by the Rook at Palm Bay, LLC, for preliminary subdivision approval of a proposed development, consisting of four (4) commercial lots and one (1) multi-family residential lot, to be known as ‘Crowne Square’, which property is located south of and adjacent to Malabar Road, in the vicinity east of Cassia Avenue and West of Corporate Circle, in CC (Community Commercial District) and RM-20 (Multiple-Family Residential District) zonings (21.0 acres) (Case PS-2-2020) (Quasi-Judicial Proceeding).

The Rook at Palm Bay (Jake Wise, P.E., Representing) has asked for Preliminary Subdivision approval for a proposed 21-acre development called Crowne Square, consisting of four (4) commercial lots and one (1) multi-family residential lot. A grocery store, retail establishment, and two (2) restaurants are proposed for the property. The site is located south of and adjacent to Malabar Road, between Emerson Drive SE and the Palm Bay Wal-Mart. The north 6.08 acres of land is zoned CC, Community Commercial, and the remaining 14.92 acres are zoned RM-20, Multiple Family Residential.

The project will have frontage on Malabar Road, will not connect to any other roadways, and a traffic signal is currently in the design stage. The applicant, however, is requesting road right-of-way waivers for a proposed internal road.

Upon review of the submittal, the Preliminary Subdivision request is in substantial conformance with the applicable requirements of the Subdivision Code. Staff does not object to requested waivers for right-of-way width.

RECOMMENDATION:

Motion to 

approve Case PS-2-2020, subject to the following items being submitted with the Final Subdivision application:

  1. Declaration of Covenants, Conditions, and Restrictions;

  2. School Concurrency Determination Letter;

  3. An Environmental Study that includes a Endangered Species Assessment;

  4. Approved Traffic Signal plans; and

  5. The name of the proposed roadway “Crown Square Way” was denied by the office of Brevard County Address Assignment. An approved name shall be provided upon the Final Plat.

Planning and Zoning Board Recommendation:

Unanimous approval of the request, subject to the staff recommendations within the staff report.

Motion by Ms. Maragh, seconded by Ms. Jordan to submit Case PS-2-2020 to City Council for Preliminary Subdivision approval for a proposed development called Crowne Square, consisting of four (4) commercial lots and one (1) multi-family residential lot, subject to items A through E being submitted with the Final Subdivision application. The motion carried with members voting unanimously.
